These Terms of Use ("Terms") are an agreement between you and Kost Konsult Ltd ("Oya!", "we", "us", or "our"), a company registered in Ghana [registration number], whose registered office is at [registered address]. They govern your use of the Oya! Bus Ride passenger mobile application and the Oya! Bus Ride website (together, "the Service").
By using the Service — including searching for trips, booking a ticket, or paying for one — you agree to these Terms. If you do not agree with them, please do not use the Service.
How we handle your personal information is described separately in our Privacy Policy, which forms part of these Terms.
Oya! Bus Ride is a booking and ticketing platform. We let you find scheduled intercity bus trips, reserve seats, pay for them, receive a ticket, and follow your bus while it travels.
The journey itself is provided by the bus operator, not by us. When you book a trip, your contract of carriage — the promise to carry you and your luggage from one place to another — is with the bus company operating that trip. We act as their booking agent. The operator is responsible for the vehicle, the driver, the route, the departure, and the conduct of the journey.
This distinction matters most when something goes wrong on the road. Section 15 explains what we are and are not responsible for.
You must be at least 18 years old to create an account or make a booking. You may book on behalf of another adult, and you may book for a child travelling with you, provided you have the authority to do so and the details you give us are accurate.
You may also book as a guest without creating an account. Guest bookings are subject to these Terms in the same way.
An unaccompanied minor may only travel where the bus operator permits it and their conditions are met. We do not arrange or supervise unaccompanied travel.
You are responsible for the accuracy of the details on your account, and for anything done through it. Keep your phone number and your access to it secure — we use your phone number to identify you and to sign you in.
Give us real information. Passenger names, phone numbers and emergency contacts are shared with the bus operator on the passenger manifest, and are used to reach you or your next of kin if there is an incident. Incorrect details can prevent boarding and can hinder help reaching you.
Tell us promptly if you believe someone else is using your account.
A booking is confirmed only when payment has been received and the Service has issued you a ticket. Selecting a seat, or starting a booking and leaving it, does not reserve anything.
Seats shown as available may be taken by another passenger while you are completing your booking. If that happens before your payment completes, we will tell you and you can choose another seat.
Trip times, prices, routes, vehicle types and seat availability are provided by the bus operators. We show them as supplied and they can change.
Occasionally a price or a trip is listed in error. Where an obvious error is discovered we may cancel the affected booking and refund what you paid in full. We will not be liable to you beyond that refund.
The total you pay is shown to you before you confirm payment. It may include the fare set by the bus operator, a service fee, and charges for luggage above the operator's allowance. All amounts are in Ghana Cedis (GHS) unless stated otherwise.
We accept mobile money and card payments through licensed payment providers. We do not store your full card details. Your payment provider's own terms and any charges they apply are between you and them.
You are responsible for making sure the account or number you pay from is one you are entitled to use. Payments from an account you do not control may be reversed and the associated booking cancelled.
If a payment fails or is left incomplete, no ticket is issued. Where a payment is taken but no ticket is issued, contact us and we will investigate and, where the payment is confirmed, either issue the ticket or refund you.
You can cancel a ticket for a full refund up to 6 hours before the scheduled departure time. The refund covers everything you paid for that booking, including the service fee and any luggage charges.
To cancel, contact our support team. The 6 hours is measured against the scheduled departure time of the trip, using the time we receive your cancellation request.
Within 6 hours of departure a ticket can no longer be cancelled for a refund. If you cannot travel, you may still be able to transfer the ticket to someone else (section 7), which costs nothing.
A passenger who does not travel and did not cancel in time is not entitled to a refund.
We refund to the account the payment came from. We start the refund as soon as the cancellation is confirmed; how long it takes to reach you depends on your payment provider, and is usually a few business days.
If a trip is cancelled by us or by the bus operator, you are entitled to a full refund whenever that happens — the 6-hour cutoff does not apply — or to be moved to another trip where one is available and you prefer that. Beyond returning what you paid, we are not responsible for other costs you incur because a trip is cancelled or delayed. See section 15.
Your ticket is personal to the passenger named on it. You may be asked for identification at boarding, and boarding may be refused if the passenger does not match the ticket.
Where the Service offers it, you may transfer a ticket to another person before the bus departs. Once transferred, the ticket belongs to the new passenger and you cannot reverse the transfer through the Service. Do not sell a ticket for more than you paid for it, and do not resell tickets commercially.
Treat your ticket code as confidential. Anyone holding it can see the trip details, and may be able to board in your place.
Arrive at the departure point in good time. Buses may leave at the scheduled time and are not obliged to wait. A passenger who is not present at departure may be treated as not having travelled.
Departure and arrival times are estimates. Traffic, weather, road conditions, breakdowns and other events outside our control affect them. Do not rely on an estimated arrival time for a connecting flight, appointment or other commitment without allowing a generous margin.
Luggage allowances, sizes and any extra charges are set by the bus operator. Declare your luggage accurately when booking; undeclared luggage may be refused or charged at the terminal.
You must not carry anything unlawful, dangerous or prohibited by the operator — including weapons, explosives, flammable goods, controlled substances, and live animals other than where the operator expressly allows them. Do not ask anyone to carry an item on your behalf without knowing what it is.
Valuables, cash, documents, electronics and medication should stay with you rather than in the hold. Responsibility for luggage during the journey rests with the bus operator, under their conditions of carriage.
Follow the reasonable instructions of the driver and crew and the operator's rules. You may be refused boarding or removed from a vehicle if you are intoxicated, behave in a way that threatens the safety or comfort of others, or refuse to comply with safety instructions. No refund is due in those circumstances.
We may offer loyalty points, discounts, promotional codes and referral codes. These are a benefit we provide voluntarily, not something you buy.
Points and codes have no cash value, cannot be sold or transferred, and cannot be exchanged for money. We may change how points are earned or what they are worth, set expiry periods, and withdraw or cancel points, codes and rewards — including where we reasonably believe they have been obtained or used abusively, for example through self-referral, duplicate or fake accounts, or automated means.
Where a promotion has its own conditions, those conditions apply in addition to these Terms.
Where the Service lets you request a vehicle for private hire or charter, your request is an enquiry, not a booking. A hire is confirmed only once it has been quoted, you have accepted the quote, and any required payment has been made. Additional conditions from the vehicle provider may apply, and will be made known to you before you commit.
The Service can show a bus's progress and let you share a tracking link. A shared link can be opened by anyone who has it, so share it only with people you intend to see your journey.
Tracking depends on the vehicle's device and on mobile network coverage. It may be delayed, incomplete or unavailable, and it is not a safety or security service.
You agree not to:
The Service, its software, its content, and the Oya! name and logo belong to us or our licensors. Using the Service does not transfer any of those rights to you.
We provide the booking platform with reasonable skill and care. We are responsible for our own failures in doing so — for example, if we take your payment and fail to issue the ticket you paid for.
We are not the carrier. We are not responsible for the safety, punctuality, conduct or condition of a bus journey, for the acts or omissions of a bus operator, its driver or its staff, or for loss, damage or injury arising during a journey. Claims of that kind are against the operator, under their conditions of carriage. We will help you identify and contact the operator concerned.
To the extent the law allows, we are not liable for indirect or consequential losses — including missed connections, missed appointments, lost profits, lost earnings, or the cost of alternative travel — arising from a delayed, cancelled or disrupted trip.
Where we are liable to you, our total liability in connection with a booking is limited to the amount you paid for that booking.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, or for fraud.
The Service depends on mobile networks, payment providers and data supplied by bus operators. We do not promise it will be uninterrupted or error-free, and we may suspend it for maintenance or change or withdraw features.
You agree to reimburse us for losses, costs and claims we reasonably incur because you have breached these Terms, given us false information, or used the Service unlawfully.
You may stop using the Service at any time, and may ask us to close your account. Closing an account does not cancel tickets already issued or refund them.
We may suspend or end your access where you breach these Terms, where we reasonably suspect fraudulent or abusive use, or where we are required to by law. Where it is reasonable to do so, we will tell you why.
These Terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have jurisdiction over any dispute arising from them or from your use of the Service.
Please contact us first. Most problems are resolved quickly by our support team, and we would rather fix something than argue about it.
We may update these Terms as the Service changes or as the law requires. The date at the top shows when they were last updated. If a change materially affects your rights, we will give you notice through the Service. Continuing to use the Service after a change takes effect means you accept the updated Terms.
The Terms that apply to a booking are the ones in force when you made it.
